Chapter 1 - General Provisions
Article 1
In this Law, the following terms shall mean:
- Immigration refers to matters related to the traffic of people entering or leaving the Territory of Indonesia and its supervision in order to safeguard state sovereignty.
- The Territory of the Republic of Indonesia, hereinafter referred to as the Territory of Indonesia, is the entire territory of Indonesia along with certain zones established under the law.
- The Immigration Function is part of the administration of the state in providing immigration services, law enforcement, state security, and facilitation of community welfare development.
- The Minister is the minister responsible for government affairs in the field of law and human rights.
- The Director General is the Director General of Immigration.
- The Directorate General of Immigration is the implementing unit of the duties and functions of the Ministry of Law and Human Rights in the field of immigration.
- Immigration Officer is a civil servant who has completed special immigration education and training, possesses technical immigration expertise, and is authorized to carry out duties and responsibilities under this Law.
- Immigration Civil Servant Investigator (PPNS Keimigrasian) is an Immigration Officer authorized by law to conduct investigations into immigration crimes.
- Foreigner means a person who is not an Indonesian citizen.
- The Immigration Management Information System is an information and communication technology system used to collect, process, and present information to support operations, management, and decision-making in carrying out the Immigration Function.
- Immigration Office is a technical implementation unit that carries out the Immigration Function in a regency, city, or district.
- Immigration Checkpoint (TPI) is a checkpoint at seaports, airports, border crossings, or other designated places for entering and leaving the Territory of Indonesia.
- Travel Document is an official document issued by an authorized officer of a country, the UN, or other international organization for international travel containing the identity of its holder.
- Immigration Document is the Travel Document of the Republic of Indonesia, as well as Residence Permits issued by Immigration Officers or foreign service officers.
- Travel Document of the Republic of Indonesia refers to the Indonesian Passport and the Indonesian Travel Document in Lieu of a Passport.
- Indonesian Passport is a document issued by the Government of the Republic of Indonesia to its citizens for international travel valid for a certain period.
- SPLP is a substitute travel document issued under certain circumstances and valid for a certain period.
- Indonesian Visa is a written statement issued by an authorized official at an Indonesian mission abroad or at another place designated by the Indonesian Government granting permission to travel to the Territory of Indonesia and forming the basis for granting a Residence Permit.
- Entry Stamp is a manual or electronic stamp affixed to a Travel Document as proof of entry.
- Exit Stamp is a manual or electronic stamp affixed to a Travel Document as proof of exit.
- Residence Permit is a permit granted to a foreigner to stay in the Territory of Indonesia.
- Integration Statement is a declaration by a foreigner to the Government of Indonesia as a requirement for obtaining a Permanent Residence Permit.
- Permanent Residence Permit is a permit granted to certain foreigners to reside permanently in the Territory of Indonesia as Indonesian residents.
- Re-entry Permit is a written permit granted to a foreign holder of a Limited or Permanent Residence Permit to re-enter the Territory of Indonesia.
- Corporation means an organized group of people and/or assets, whether incorporated or not.
- Sponsor is a person or corporation responsible for the presence and activities of foreigners while in Indonesia.
- Carrier refers to ships, aircraft, or other means of transportation commonly used.
- Prevention is a temporary prohibition against someone leaving Indonesia for certain reasons.
- Blacklist is a prohibition against foreigners from entering Indonesia based on immigration reasons.
- Immigration Intelligence is investigative and security activities conducted to analyze immigration situations.
- Immigration Administrative Action refers to administrative sanctions outside the judicial process.
- Human Smuggling is the act of bringing a person or group of people to obtain financial or other material benefits...
- Immigration Detention Center (Rudenim) is a technical unit serving as a temporary holding place for foreigners subject to Immigration Administrative Action.
- Immigration Detention Room is a temporary holding place located at the Directorate General of Immigration and Immigration Offices.
- Detainee is a foreigner placed in an Immigration Detention Center or Room based on a detention decision.
- Deportation is the forced removal of a foreigner from Indonesia.
- Carrier's Responsible Person is the owner, manager, agent, captain, pilot, or driver of the means of transportation.
- Passenger means any person on board a means of transportation, except the crew.
- Indonesian Mission refers to the Indonesian Embassy, Consulate General, and Consulate.
Article 2
Every Indonesian citizen has the right to travel abroad and re-enter the Territory of Indonesia.
