Procedure for Work and Stay Permits for Foreign Workers (Expatriates) in Indonesia

    Expatriate Manpower Utilization Plan (RPTKA)

    The sponsoring company submits an RPTKA to the Ministry of Manpower of Indonesia (Kemnaker) as a mandatory planning document for employing foreign workers. The RPTKA outlines the job title, duration of employment, number of expatriates, and work location. Once approved, the RPTKA Endorsement is issued as the initial legal basis.

    Notification or Expatriate Employment Permit (IMTA)

    Based on the approved RPTKA, the company must apply for a Notification of foreign manpower utilization. At this stage, the company is also required to pay the Compensation Fund for the Utilization of Foreign Workers (DKPTKA) to the state. The Notification document issued by the Ministry of Manpower then serves as the official work permit for expatriates.

    Application for Limited Stay Visa (VITAS)

    With the Notification document, the company applies for a Limited Stay Visa (VITAS) at the Directorate General of Immigration. Immigration will issue a visa approval letter (telex visa) addressed to the Indonesian Embassy or Consulate in the expatriate's country of origin.

    Arrival of the Expatriate in Indonesia

    The expatriate enters Indonesia using the VITAS. Upon arrival, the immigration system automatically issues an electronic Limited Stay Permit (ITAS). The ITAS simultaneously functions as the Limited Stay Permit Card (KITAS).

    Reporting to Authorities and Supporting Documents

    After arrival, the expatriate must report to the local Manpower Office and complete additional supporting documents as required, such as presence reporting, Taxpayer Identification Number (NPWP) for employment exceeding six months, registration with BPJS (Social Security), and other administrative documents.

Extension and Status Change of Foreign Worker Stay Permits (TKA) in Indonesia

    Extension of Visit Stay Permit (ITK)

    The ITK extension is granted to Foreign Workers (TKA) holding:

    • Single-Entry Visitor Visa
    • Multiple-Entry Visitor Visa
    • Visa on Arrival (VoA)

    Extension of Limited Stay Permit (ITAS)

    The ITAS extension is granted for various categories of Foreign Workers (TKA) based on the purpose of stay and employment, including:

    • Experts with professional or specialized skills in specific fields.
    • Foreign workers employed by companies or sponsors in Indonesia.
    • Foreign nationals working on ships, floating equipment, or installations operating in Indonesian waters, territorial seas, continental shelf, or the Indonesian Exclusive Economic Zone.
    • Clergy members performing religious duties in Indonesia.
    • Foreign investors investing in Indonesia.
    • Researchers or scientists conducting scientific research.
    • Students or participants in educational programs in Indonesia.
    • Foreign nationals joining family members holding ITAS (family reunification).
    • Foreign nationals undergoing repatriation or relocation in Indonesia.
    • Holders of a second home permit in Indonesia under applicable regulations.
    • Foreign nationals invited by the government for their expertise (global talent).
    • World figures or international personalities officially invited.
    • Foreign Workers aged 60 years or older who meet residence requirements.

    General Requirements for ITAS Extension:

    • A valid and legitimate national passport as the official identity of the Foreign Worker (TKA).
    • Statement of integration, except for unmarried children under 18 years old.
    • The ITAS held by the respective Foreign Worker (TKA).
    • Guarantee from the Sponsor, if applicable.
    • Identity Card (KTP) and/or Family Card of the Sponsor or Responsible Party, if applicable.
    • ITAS of the spouse, parent, or child for Foreign Workers joining family members holding ITAS.

    Extension of Permanent Stay Permit (ITAP)

    The ITAP extension allows Foreign Workers (TKA) to legally maintain their permanent stay permit in Indonesia as requested.

    • Permanent Stay Permits (ITAP) may be extended without time limitation as requested by the TKA.
    • ITAP extension applications can be submitted from 3 months before the ITAP expiry until the last valid day.
    • The extension takes effect from the expiration date of the previous ITAP.
    • Immigration fee payments made before ITAP expiry remain valid. Applications processed beyond the ITAP validity period are not considered overstay.

    Conversion of Visit Stay Permit (ITK) to Limited Stay Permit (ITAS)

    Converting ITK to ITAS allows Foreign Workers (TKA) to continue residing and working legally in Indonesia before the visit period ends.

    • Applications for conversion must be submitted no later than 30 days before the ITK expiry date.
    • Applications are submitted by the Foreign National, Sponsor, or Responsible Party via the application system to the local Immigration Office Head.
    • Eligible activity categories for conversion:
      • Expert
      • Worker
      • Clergy
      • Foreign investor
      • Scientific research
      • Education
      • Family reunification
      • Repatriation
      • Second home
      • Medical treatment
      • Public welfare and/or humanitarian reasons
    • ITK obtained from Visa on Arrival (VoA) or Visa Exemption cannot be converted to another stay permit.
    • Applications submitted and paid before the ITK expiry remain valid. Applications processed beyond the validity period are not considered overstay.

    Conversion of Limited Stay Permit (ITAS) to Permanent Stay Permit (ITAP)

    Converting ITAS to ITAP allows Foreign Workers (TKA) to maintain permanent residency legally in Indonesia before ITAS expires.

    • Applications for conversion must be submitted no later than 30 days before the ITAS expiry date.
    • Applications are submitted by the Foreign National, Sponsor, or Responsible Party via the application system to the local Immigration Office Head.
    • Eligible activity categories for conversion:
      • Worker
      • Clergy
      • Foreign investor
      • Family reunification
      • Repatriation

      • Special expertise
      • World figure
      • Foreign Worker aged 60 years or older

    Granting of Permanent Stay Permit (ITAP) Without Conversion

    ITAP may be granted directly without conversion for certain categories under regulations.

    • Former dual-national children of the Republic of Indonesia who chose foreign citizenship or failed to choose until the age of 21 while in Indonesia.
    • Children born in Indonesia to ITAP holders.
    • Indonesians who lost their citizenship while in Indonesia.

    Notes:

    • ITAP is granted directly without conversion procedures upon application to the local Immigration Office Head.
    • ITAP is granted for a period of 5 years.
    • ITAP for applicants under family reunification or children born in Indonesia follows the validity of the ITAP held by the Foreign National they join.

    Reporting of Permanent Stay Permit (ITAP)

    Foreign Workers (TKA) holding ITAP must report every 5 years to the Immigration Office in their area of residence.
